1. Agreement to Terms

By creating an account or using the Unsendable web application and related services (collectively, the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, do not use the Service.

Unsendable is a private practice platform that allows you to rehearse difficult real-life conversations with AI-generated personas. You describe a real person, the Service constructs a reusable AI persona and generates an avatar image, and you practice the conversation privately. The Service uses large language models and image generation AI to power these features.


3. Eligibility

You must be at least 18 years old to create an account or use the Service. By using the Service, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into these Terms.


4. Accounts

4.1 Registration

You must register for an account to access the core features of the Service. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

4.2 Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at [CONTACT EMAIL] if you suspect unauthorized access to your account.

4.3 One Account Per User

Each individual may maintain only one account. Creating multiple accounts to circumvent suspensions or content policies is prohibited and may result in permanent termination.


5. Subscription Plans and Credits

5.1 Subscription Tiers

The Service offers subscription plans (Basic, Plus, and Premium) billed on a monthly basis. Each plan includes a set of included features, avatar storage slots, and a monthly credit allowance. Subscription pricing and feature details are described on our pricing page, which we may update from time to time.

5.2 Credits

Many actions within the Service consume credits, including but not limited to:

  • Creating a new persona / avatar
  • Generating avatar images
  • Starting or continuing conversation sessions
  • Generating strategy synthesis notes
  • Using the Branch Explorer feature

Credits included with a subscription are refreshed at the start of each billing cycle. Credits purchased separately do not expire.

5.3 Pay-As-You-Go

Users without an active subscription, or subscribers who have exhausted their included credits, may purchase credit packs. Credit pack pricing is displayed at the time of purchase.

5.4 No Refunds on Credits

Purchased credits are non-refundable except where required by applicable law. Credits consumed through normal use of the Service will not be refunded.

5.5 Billing

We use Stripe to process payments. By subscribing or purchasing credits, you authorize us to charge your payment method on the schedule applicable to your plan. All prices are listed in USD unless otherwise stated. You are responsible for any applicable taxes.

5.6 Subscription Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. You retain access to your plan's features until that date.


6. Acceptable Use

6.1 Permitted Use

The Service is provided for personal, private practice of interpersonal communication skills. You may use it to prepare for difficult workplace, personal, or social conversations.

6.2 Prohibited Content

You agree not to submit, generate, or attempt to generate through the Service any content that:

  • Harasses or bullies any individual, including targeted personal attacks designed to demean or intimidate.
  • Defames any individual, including creating personas designed to spread false statements of fact.
  • Sexualizes any individual, whether real or fictional.
  • Promotes self-harm, suicide, eating disorders, or other self-destructive behavior.
  • Constitutes illegal content under applicable law, including content that incites violence or facilitates criminal activity.
  • Involves manipulation or deception intended to cause real-world harm to another person.
  • Violates the rights of any third party, including intellectual property rights or rights of privacy.

6.3 Prohibited Conduct

You also agree not to:

  • Attempt to circumvent content moderation systems.
  • Use the Service to train, fine-tune, or develop competing AI models.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Use automated scripts, bots, or scrapers to interact with the Service without our written permission.
  • Attempt to gain unauthorized access to other users' accounts or our systems.
  • Resell or sublicense access to the Service without our written permission.

7. Content Moderation

7.1 Automated Moderation

The Service uses automated AI moderation to review inputs and outputs for prohibited content. Moderation occurs before content is sent to AI models and before responses are returned to you. Moderation may occasionally flag permissible content; if you believe a legitimate message was blocked in error, contact us.

7.2 Strike Policy

We apply a progressive enforcement policy for content policy violations:

  • First violation: Warning issued via the Service interface; the event is logged.
  • Second violation: Temporary account suspension (24 hours).
  • Third violation, or a single egregious violation: Permanent account suspension, subject to manual review.

7.3 Moderation Records

Moderation event records are retained indefinitely to enforce the multi-strike policy across sessions. These records are maintained as described in our Privacy Policy.

7.4 Appeals

If you believe your account was suspended in error, contact us at [CONTACT EMAIL] with a description of the circumstances. We will review your appeal and respond within a reasonable time. We reserve the right to make final enforcement decisions.


8. Intellectual Property

8.1 Our Property

8.3 AI-Generated Output

8.4 Feedback

If you submit ideas, feedback, or suggestions about the Service, you grant us a perpetual, irrevocable, royalty-free right to use that feedback for any purpose without obligation to you.


9. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in the Privacy Policy.


10. Third-Party Services

The Service relies on third-party providers including Anthropic (AI text generation), OpenAI (image generation), Clerk (authentication), Stripe (payments), and Railway (hosting). Your use of the Service is subject to each provider's applicable terms. We are not responsible for the conduct or policies of these third parties.


11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, error-free, or secure.
  • AI-generated personas accurately represent any real person.
  • Conversation practice will produce any particular outcome in real-life interactions.
  • Any content generated by the Service is factually accurate.

The Service is a private practice tool only. It does not provide therapy, counseling, legal advice, or medical advice. If you are experiencing a mental health crisis, please contact a qualified professional or emergency services.


12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, [COMPANY NAME] AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRIOR TO THE CLAIM, OR (B) USD $50.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability is limited to the maximum extent permitted by law.


13. Indemnification

14. Account Deletion

You may delete your account at any time from your account settings. Upon deletion, we will permanently delete all personal data associated with your account, including avatars, conversations, messages, images, credit balances, and strategy notes. Billing records and fraud prevention records required by law will be retained. Deletion is irreversible; we cannot recover deleted accounts or content.


15. Termination by Us

We reserve the right to suspend or terminate your account at our discretion if:

  • You violate these Terms or our content policy.
  • We are required to do so by law.
  • We determine that continued access poses a risk to other users or to the integrity of the Service.

Upon termination for cause, your right to use the Service ceases immediately. Credits and unused subscription time are generally non-refundable upon termination for violation, except where required by applicable law.


16. Changes to the Service and Terms

We may modify the Service or these Terms at any time. If we make material changes to these Terms, we will provide at least 14 days' notice by email or by a prominent notice within the Service. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.

We may also discontinue the Service or any feature with reasonable notice. We are not liable for any modification, suspension, or discontinuation of the Service.


17. Governing Law and Dispute Resolution
